About the Seminar:

Further to the Financial Secretary's proposal of enhancing the development of the wealth and asset management business in Hong Kong in the 2014/15 and 2015/16 Hong Kong Budgets, the Inland Revenue (Amendment) (No.4) Bill 2015 was gazetted on 4 December 2015. The Bill seeks to: (1) introduce a concessionary profits tax rate for a corporate treasury centre (CTC) in Hong Kong, (2) enhance the interest expense deduction for an intra-group financing business carried on in Hong Kong by a corporation, and (3) clarify the tax treatments in respect of regulatory capital securities issued by financial institutions in compliance with Basel III capital adequacy requirements.

This seminar will focus on the tax proposals in (1) and (2) above. The speaker will talk about:

- the conditions for a CTC in Hong Kong to enjoy the concessionary tax rate;

- the new interest expense deduction rule for an intra-group financing business carried on in Hong Kong by a corporation;

- the new deeming provisions for interest income and certain profits derived from an intra-group financing business carried on in Hong Kong by a corporation;

- the anti-avoidance provisions proposed in the Bill;

- potential issues surrounding the interpretation and application of the proposed tax legislation; and

- issues to consider for companies considering setting up a CTC in Hong Kong.

About the Speaker:

Mr Charles CHAN is a director in the Corporate Tax group of PricewaterhouseCoopers, Hong Kong. He has over 13 years of experience in providing tax consulting services to local, regional, multi-national and listed companies. Charles also has experience working as an Assistant Assessor in the Profits Tax Section of the Hong Kong Inland Revenue Department (IRD).

Over the years, Charles has been assisting many clients to handle different types of tax disputes with the IRD. Charles also has extensive experience in providing international tax consultation to his clients as well as involvement in tax planning and tax structuring work for companies with cross-border transactions. He has involved in many business advisory projects including merger and acquisitions and the set up of efficient corporate holding and operational structure for his clients.

Charles holds a Bachelor of Business Administration degree (major in Accounting and Finance) from the University of Hong Kong. Besides, he is a member of the Association of Chartered Certified Accountants.
